Terms and Conditions

1. Overview

This website is operated by Nine Two Twenty Pty Ltd (ABN 50 660 552 198) trading as DB Active (“DB Active”, “we”, “us”, “our”). By accessing or purchasing from dbactive.co (the “Site”), you agree to these Terms & Conditions (“Terms”). These Terms apply to all users of the Site, including browsers, customers, and contributors of content.

Our online store is hosted on Shopify, which provides the e-commerce platform allowing us to sell our products and services to you.

 

2. Contract Formation

  • Product listings are invitations to purchase, not binding offers.

  • By clicking “Checkout” and completing your purchase, you make an offer to buy.

  • We accept when we send you a shipping confirmation email or dispatch your order.

  • We may refuse or cancel orders for reasons including (but not limited to) pricing errors, out-of-stock items or suspected fraud.

3. Pricing, Payments & Taxes

  • Prices are displayed in the currency selected for your region on our website. Customers can update their region/currency using the selector in the header.

  • Prices may change without notice but will not affect confirmed orders.

  • Payment is due in full at checkout via our accepted payment providers (e.g., Stripe, PayPal, ShopPay etc.)

Taxes & Duties

  • Australian Orders: GST is included in the price at checkout.

  • International Orders: For most international countries, duties, VAT, import taxes, and fees are your responsibility and are not collected or refunded by DB Active.

  • United States Orders: DB Active ships DDP (Delivered Duty Paid), meaning applicable duties and taxes are included at checkout - there are no additional fees to pay on delivery.

4. Shipping & Delivery

  • We aim to process and dispatch orders within 1–3 business days. During launches, sales, or peak periods, dispatch may take longer.

  • Delivery times are estimates only; delays outside our control (couriers, customs) may occur.

  • Shipping costs are shown at checkout and are non-refundable.

  • If a parcel is undeliverable and returned to us, the cost of return shipping may be deducted from your refund or credit.

5. Returns, Exchanges & Refunds

Our [Returns Policy] applies in full. Key points:

  • Change of Mind: You may return eligible items within 30 days for exchange or store credit (item must be unworn, unwashed, tags attached, in original packaging).

  • Faulty Items: If you believe an item is faulty, email hello@dbactive.co with your order number and photos for assessment.

  • Processing: Returns are processed within 3–5 business days of receipt. Refunds are issued to your original payment method (allow 5–10 business days to appear).

  • Important: Refunds, credits, and exchanges exclude shipping costs, taxes, duties, and any international fees.

  • Items marked “Final Sale”, underwear/socks and items that fail inspection are not eligible for return.

6. Accuracy, Availability & Modifications

  • We strive for accuracy in product descriptions, images and pricing. Minor variations may occur due to device displays or production.

  • We may change, discontinue, or limit quantities of products at any time.

  • We may correct errors (including pricing) at any time, including after an order is placed, with notice to you.

7. Account & Billing

  • You agree to provide current, complete, and accurate information when purchasing.

  • If you make an error in your order or shipping address, contact us immediately. If already dispatched, you may need to process a return at your cost.

8. Promotions, Discounts & Gift Cards

  • Promotions may have minimum spends, exclusions, or limited durations.

  • Discount codes apply proportionally across items and are not reissued on returns.

  • Gift cards and store credits are not redeemable for cash and are valid for 3 years from date of issue (unless otherwise required by law).

9. Social Media & User-Generated Content (UGC)

By tagging @dbactive on social media, you acknowledge and agree that your content (“Content”) may be used by DB Active across our digital channels, including but not limited to:

  • Our social media platforms

  • Our website (including “As Seen On” sections)

  • Marketing emails, SMS communications, and paid advertising

You grant us permission to use your name, username, and/or social media handle in connection with your Content for identification purposes.

By posting and tagging DB Active, you confirm that:

  • You own all rights to your Content and have permission from anyone else featured in it

  • Your Content complies with the terms & conditions of the platform where it was posted

  • DB Active may edit, crop, or modify your Content without notice

  • DB Active will not be liable for any claims or demands made by third parties in relation to the use of your Content

If you wish to withdraw permission for the use of your Content, please contact hello@dbactive.co and include a link or screenshot of the Content you would like removed.

10. Intellectual Property

All images, logos, product designs, and text on this Site are owned by or licensed to DB Active. You may not reproduce or exploit content without prior written permission.

11. Acceptable Use

You must not use this Site to:

  • Break the law or infringe rights of others.

  • Upload harmful code, viruses, or spam.

  • Harass, abuse, defame, or discriminate.

  • Circumvent security or misuse our systems.

We reserve the right to suspend or terminate your access for violations.

12. Third-Party Services & Links

We may offer links to third-party websites or services. These are not under our control, and we are not responsible for their content or policies. Your use is at your own risk.

13. Warranties & Liability

  • Our products come with guarantees under the Australian Consumer Law that cannot be excluded.

  • To the extent permitted by law, DB Active excludes liability for indirect or consequential loss.

  • Our liability is limited, at our option, to the repair, replacement, or refund of the goods.

14. Privacy

Your personal information is handled per our [Privacy Policy], available on our Site.

15. Termination

We may suspend or terminate your access if you breach these Terms. Obligations incurred before termination (including payment) survive termination.

16. Governing Law

These Terms are governed by the laws of Queensland, Australia. You submit to the non-exclusive jurisdiction of Queensland courts.
